La infracción al deber objetivo de cuidado (IDOC) es una figura introducida en Ecuador en el 2014 con el COIP, con 4 requisitos concurrentes. Para las actuaciones de los Anestesiólogos es necesario evaluar conjuntamente: la ley y reglamento de la especialidad, las normas mínimas de seguridad de la CLASA y los documentos sobre “cirugía segura” de la OMS. Investigamos en este artículo si existe relación entre estas últimas normas y los requisitos mencionados. El objetivo es encontrar la antes mencionada relación (...) y revisar su realidad procesal. Para ello realizamos análisis documental mediante lógica jurídica. Como resultado obtuvimos una correspondencia entre estas normas y los elementos de la IDOC, así como una ausencia de su consideración dentro de las sentencias evaluadas. Se concluye que, si bien son legalmente exigibles, estas normas no son siempre analizadas cuando se juzga una supuesta IDOC, por lo que es necesaria su incorporación al ámbito judicial. (shrink)

In the early twenty-first century, philosophy stemming from the continental tradition has become overtly realist. This does not mean it abandons the sophisticated structures of reflection for a givenness on the refutation of which its earliest moments, in Kant, was premised. Nor does it entail a rediscovered faith in the adequacy of intellect to thing. Rather, we might say, new realisms have issued from a critique of transcendental dogmas. This study was designed to investigate the effects of aging on consciousness in recognition memory, using the Remember/Know/Guess procedure . Remembering and Knowing. In E. Tulving & F. I. M. In recognition memory, older participants report fewer occasions on which recognition is accompanied by recollection of the original encoding context. Two main hypotheses were tested: the speed mediation hypothesis . The processing-speed theory of adult age differences in cognition. Psychological Review, (...) 3, 403–428) and the executive-aging hypothesis . An application of prefrontal cortex function theory to cognitive aging. Psychological Bulletin, 120, 272–292). A group of young and a group of older adults took a recognition test in which they classified their responses according to Gardiner, J. M., & Richarson-Klavehn, A. . Remembering and Knowing. In E. Tulving & F. I. M. Craik , The Oxford Handbook of Memory. Oxford University Press. remember-know-guess paradigm. Subsequently, participants completed processing speed and executive function tests. The results showed that among the older participants, R responses decreased, but K responses did not. Moreover, a hierarchical regression analysis supported the view that the effect of age in recollection experience is determined by frontal lobe integrity and not by diminution of processing speed. This article serves as an introduction to the laws-of-biology debate. After introducing the main issues in an introductory section, arguments for and against laws of biology are canvassed in Section 2. In Section 3, the debate is placed in wider epistemological context by engaging a group of scholars who have shifted the focus away from the question of whether there are laws of biology and toward offering good accounts of explanation(s) in the biological sciences. Section 4 introduces two relatively new (...) pieces of science – metabolic scaling theory and ecological stoichiometry – that have not been topics of much discussion by philosophers but are relevant because they have at least some of the hallmarks of laws of nature. Section 5 concludes by pointing out that discovering laws of biology, if any there be, will not necessarily answer the questions raised by the debate in the first place: we will still want to know how biology compares to other sciences, how to characterize its systems and processes, and whether accounts in terms of laws always or usually constitute adequate explanations in various sciences. ABSTRACT Ted Gioia associated the “aesthetics of imperfection” with improvised music. In an earlier article, I extended it to all musical performance. This article reconceives my discussion, offering more precise analyses: The aesthetics of imperfection is now argued to involve open, spontaneous response to contingencies of performance or production, reacting positively to idiosyncratic instruments; apparent failings in performance, and so on. Perfectionists, in contrast, prefer a planning model, not readily modified in face of contingencies. Imperfection is not toleration of errors (...) and imperfections, as Gioia assumes, but a positive aesthetic, as in Japanese wabi-sabi. Imperfections can become new styles or kinds of perfection—and so true imperfectionism is a constant striving for new contingencies to respond to. A subtler, more complex relation between composition and improvisation is proposed, in which both have broad and narrow senses. Composition involves works, usually desk produced and notated; or more generally, putting things together in an aesthetically rewarding form. Thus, improvisation is a compositional method. Improvisation and composition are interdependent; both involve structure and spontaneity. Imperfectionism is an aesthetics of performance—of compositions as well as improvisations. Improvisation is no risker, or prone to mistakes, than performance of compositions. (shrink)

In 2000, researchers from the Human Genome Project proclaimed that the initial sequencing of the human genome definitively proved, among other things, that there was no genetic basis for race. The genetic fact that most humans were 99.9% the same at the level of their DNA was widely heralded and circulated in the English-speaking press, especially in the United States. This pronouncement seemed proof that long-term antiracist efforts to de-biologize race were legitimized by scientific findings. Yet, despite the seemingly widespread (...) acceptance of the social construction of race, post-HGP genetic science has seen a substantial shift toward the use of race variables in genetic research and, according to a number of prominent scholars, is re-invoking the specter of earlier forms of racial science in some rather discomfiting ways. During the past seven years, the main thrust of human genetic research, especially in the realm of biomedicine, has shifted from a concern with the 99.9% of the shared genome — what is thought to make humans alike — towards an explicit focus on the 0.1% that constitutes human genetic variation. Here I briefly explore some of the potential implications of the conceptualization and practice of early 21st century genetic variation research, especially as it relates to questions of race. Since the publication of The Sexual Politics of Meat in 1990, activist and writer Carol J. Adams (2000 [1990]) has put forth a feminist defence of veganism based on the argument that meat consumption and violence against animals are structurally related to violence against women, and especially to pornography and prostitution. Adams’ work has been influential in the growing fields of animal studies and posthumanism, where her research is frequently cited as the prime example of vegan feminism. However, her particular (...) radical feminist framework, including her anti-pornography and anti-prostitution arguments, are rarely acknowledged or critiqued. This article challenges the premises of Adams’ argument, demonstrating that her version of vegan feminism is based upon an unsubstantiated comparison between violence against women and violence against other-than-human animals, and on the silencing and exclusion of sex workers as subjects. The article contests the limited reading of Adams, and of feminism, offered in some key works in animal studies and posthumanism, at the same time that it recognises the need to challenge the anthropocentrism evident in much feminist theory. By way of alternative approaches to the sexual politics of veganism, the article highlights the interventions of artist and activist Mirha-Soleil Ross, proposing that her situated and embodied commitment to animal rights brings sex worker agency into the story, while resisting simple comparisons among different forms of violence. The concerns raised by Ross overlap in compelling ways with recent research in performance studies and labour history, bringing the question of work and workers, animal and human, to the fore. These studies point towards a potentially more useful framework than that of Adams for understanding the human violence suffered by different species, including those destined to be eaten by people. Scruton is a self-confessed elitist for whom culture is ‘the creation and creator of elites’, though its meaning ‘lies in emotions and aspirations that are common to all’. This article argues that one can uphold his humane conception of the value of high culture without endorsing elitism. It develops a surprisingly unelitist strand in Scruton's thinking into a meritocratic middle way between elitism and populism, in order to explain why art is in some sense an elite product, but with communal (...) resonance. This aim is furthered by interpreting high culture in terms of the less elitist concept of the classic. (shrink)

Nietzsche's tortured relationship to the Christian God has received scant attention from commentators. In this paper I seek to map out the central lines a proper understanding of Nietzsche in this regard might take. I argue that fundamental in such an understanding is Nietzsche's profoundly corporeal moral vocabulary, and I trace connections between this vocabulary and Nietzsche's concern with cleanliness, his asceticism, and the notion of a sense of common humanity with others.

This essay is a survey of positions on the relation between texts and performances in theater. It proposes a simple framework within which to compare and evaluate these positions. The framework also allows us to see a pattern of thinking that reflects the historical fact of the importance of the literary tradition in theater. The essay points out certain challenges facing the positions surveyed and concludes with a brief sketch of the most recent views that have been put on offer. (...) The object of this article is to examine the letter from which Plutarch quotes in the above passage from the twenty-eighth chapter of his life of Alexander; to attempt to prove, particularly by a comparison of the letter with the Sidypafifia sent in 319 B.C. by Polyperchon to the Greek cities, that it is a genuine part of Alexander's correspondence; and further to consider what light the letter, if genuine, throws upon the person of Alexander himself.

The modern conception of self-consciousness holds that, in self-conscious thought, I think of myself as both subject and object; and that the subject is essentially embodied. This understanding begins with Kant. An anti-metaphysical treatment regards 'What is a self?' as expressing a pseudo-problem; it regards the claim of an immaterial self as nonsensical, and diagnoses its postulation. A moderate anti- metaphysical position analyses self-consciousness by appeal to the Analytic Principle: that self-consciousness is a phenomenon expressed -- or interpreted -- by (...) use of a device with the properties of the first person. This article proposes a strong interpretation of the Principle, involving the conceptual holism of self-consciousness and self-reference. But how essential is the use of 'I' to self-consciousness? In the name-user scenario, each speaker uses their own name self-consciously to self-refer. However, in this scenario, against appearances, 'I' is not in fact eliminated without loss of the language's expressive power, and so the Analytic Principle is preserved. (shrink)

Introduction: Cognitive behavioral therapy for children and adolescents has shown efficacy in treating different psychiatric disorders. It has been added to multiple clinical guidelines as the first-line treatment. However, despite more studies of its efficacy, CBT is underutilized in clinical settings due to a lack of rigorous training programs and qualified CBT therapists. The limited knowledge of parents in this intervention and their negative attitudes toward it have been considered as possible reasons.Methods: This is a cross-sectional survey-based study among 464 (...) Saudi parents living in Riyadh city. We aimed to evaluate the preference, knowledge, and attitudes of Saudi parents toward CBT for their children. We compared the difference in the level of knowledge and attitudes toward CBT in relation to the characteristics of parents. An online questionnaire that included 39 questions was carefully reconstructed from four validated scales, approved by an expert panel, and piloted. Participants were recruited to participate through online social media.Results: Saudi parents had average knowledge about CBT; however, they had positive attitudes toward the therapy itself and its role in treating the behavioral issues of children. Male participants showed better knowledge than female participants. Participants with higher education and those with high income had more favorable attitudes toward CBT than others.Conclusion: The knowledge of parents is considered inadequate and indicated the need for more awareness and perhaps mass education. In contrast, they maintained positive attitudes and were interested in evidence-based treatment, with more preference toward non-psychopharmacological interventions. (shrink)

Historiquement, le flou sémantique qui les caractérise a toujours compliqué la tâche de ceux qui se sont efforcés de leur attribuer une « valeur » esthétique, par exemple au sein d’une hiérarchie des genres. Il s’agit toujours d’endiguer leur dangereux excès asymbolique en les déchiffrant, en leur imposant symboles et prédicats. Le présent essai propose une analyse d’ Un re (...) in ascolto [ Un roi à l’écoute ] d’Italo Calvino (1976), redéfinissant à nouveaux frais la notion de souveraineté afin de mieux comprendre la nature d’une telle stratégie herméneutique, et les raisons de son échec. Le souverain tel que nous le décrit Calvino est-il en mesure de conférer un sens à la musique et au chant en les intégrant au sein d’un système sémantique clos? Ou l’expérience musicale doit-elle au contraire être décrite comme fondamentalement incompatible avec une telle herméneutique totalisante, appelant une analyse fondée sur une vision pluraliste, horizontale, et non-hiérarchique des relations entre les différents modes d’expression artistique? A key epistemic puzzle about theatrical performances of fictional narratives has to do with how spectators pick out and recognize the characters they encounter. An adequate solution to the puzzle is constrained by several factors : it should be similar to what we need to say about picking out and recognition of characters in non-fictional narratives ; it should be similar to what we need to say about picking out and recognizing elements in non-narrative performances ; it be it must (...) be sensitive to the fact that most plays do not name or describe their characters ; it must be sensitive to the fact that most spectators have no prior experience or preparation for what they will encounter ; and it must comport with any plausible story we have to tell about the mechanisms we bring to the identification and re-identification of individuals in daily life. In this paper, I review a solution that meets these constraints and, in particular, I show why the proposed solution is likely to be subserved by very basic cognitive mechanisms involved in object perception and recognition in everyday life. I conclude by responding to ontological worries the solution is likely to foster. (shrink)

The importance of Pyrrhonism to Hobbes's political philosophy is much greater than has been recognized. He seems to have used Pyrrhonist arguments to support a doctrine of moral relativity, but he was not a sceptic in the Pyrrhonist sense. These arguments helped him to develop his teaching that there is no absolute good or evil; to minimise the purchase of natural law in the state of nature and its restrictions on the right of nature; virtually to collapse natural law into (...) civil law; and to make the sovereign the political, moral and theological epicenter of his political system. Jonathan Edwards′ New England theology has a great deal more to say that is of contemporary doctrinal interest than it is often credited with, particularly as it relates to the doctrine of atonement. This article explores several anomalous claims made be this 18th and 19th century tradition, and in this way, challenges the recent and growing consensus that Edwards espoused the penal substitution model and his successors a moral government model. I argue that of all that is yet to be (...) considered about their doctrine of atonement, we ought to begin with those claims made about the nature and demands of divine justice. (shrink)

Shame is a ubiquitous and highly intriguing feature of human experience. It can motivate but it can also paralyse. It is something which one can legitimately demand of another, but is not usually experienced as a choice. Perpetrators of atrocities can remain defiantly immune to shame while their victims are racked by it. It would be hard to understand any society or culture without understanding the characteristic occasions upon which shame is expected and where it is mitigated. Yet, one can (...) survey much of the literature in social and political theory over the last century and find barely a footnote to this omnipresent emotional experience.
